Online Courses - Terms & Conditions

These Terms and Conditions together with the booking form comprise the agreement by which Synthesis Learning in collaboration with ExP Digital Ventures Ltd. provides online courses to you, the candidate. The term courses shall include courses, tests, study material, and such items as included on the online course portal.

Please read these Terms and Conditions carefully before purchasing an online course and print off a copy for your records. By ordering a course, you are confirming your agreement to be bound by these Terms and Conditions.

1. Payment terms

1.1 All booking forms must be accompanied by payment in full or the employer or sponsor’s authorization to be invoiced directly.

1.2 Where the employer or sponsor has agreed to pay, full payment will be due in accordance with the terms agreed by the employer.

1.3 Synthesis Learning reserves the right to cancel any online course if full payment is not received by the employer or sponsor by the agreed due date.

2. Booking and registration

2.1 It is the responsibility of the person making the booking to ensure that the selected courses are appropriate for their needs.

2.2 Any change in the candidate’s contact details must be notified to Synthesis Learning in writing.

2.3 Synthesis Learning does not accept responsibility for registering candidates with professional bodies or entry for the relevant written exams. The candidate holds full responsibility with regard to any fees and deadlines associated with their professional exams. Synthesis Learning is not responsible for making any registration to the professional bodies on behalf of the candidate, of making any payment to the professional bodies on behalf of the candidate, or of informing the candidate on any deadlines or fees related to the professional bodies. All such activities are the sole responsibility of the candidate.

2.4 Courses and study materials are not transferrable between candidates.

2.5 If an individual has registered on a course for a particular paper and has not accessed that course, they may switch their course to another paper with the same expiry date as their original course. If the course they are switching to has a higher fee than the original course the difference will be payable. A Rs 5,000 / administration fee per paper switched will be charged. Individuals wishing to change courses should email learning@synthesisgroup.in.

2.6 Any pricing, promotions, or discount codes can be changed or withdrawn by Synthesis Learning without notice.

2.7 Synthesis Learning does not provide any assistance on visa services to students who want to travel abroad post completion of the course.

3. Online Courses and Resources

Once the candidate pays the course fees, the terms and conditions of ExP Digital Ventures Ltd in relation to ‘Online courses and resources’ accessible at https://www.exp247.com/terms_and_conditions.html will apply and you agree to be bound by `such terms and conditions.           

4. Intellectual property

4.1 The copyright in and all other intellectual property rights relating to the online course (information, software, training material content, data, and documentation) provided to the student are owned exclusively by and hereby reserved to ExP Digital Ventures Ltd and/or its party licensors and the terms in relation to use of such intellectual property rights as mentioned in ExP Digital Ventures Ltd.’s terms and conditions accessible at https://www.exp247.com/terms_and_conditions.html shall apply and you agree to be bound by the said terms and conditions.

5. Liability

5.1 The liability of Synthesis Learning for direct losses arising out of its negligence (other than in respect of liability for death or personal injury), breach of contract, or any other cause of action arising out of or in connection with this agreement is limited to the value of monies received from the candidate (or their employer) for the course.

5.2 Synthesis Learning shall not be liable for any consequential or indirect loss, howsoever arising.

6. Connecting to your online course.

6.1 In order to connect to the online courses, the candidate will need access to the internet with a suitable up-to-date internet browser.

6.2 Any internet usage fees are the responsibility of the candidate.

6.3 Synthesis Learning specifically takes no responsibility for any slow internet or bandwidth issues that the candidate may face in using the online portal.

6.4 There is no guaranteed uptime on the online courses and Synthesis Learning reserves the right for the online course to be unavailable due to maintenance or technical issues. Every effort will be made to ensure that such maintenance takes place at non-peak times although this cannot be guaranteed.

7. Data protection

7.1 The candidate agrees to allow Synthesis Learning to retain information and use it to:
– communicate with the candidate to perform their obligations under this agreement;
– inform candidates about their courses, products, and services which may be of interest;
– provide feedback to candidates on their progress and exam performance;
– communicate with the candidate’s employer or university/college regarding their progress, results, and attendance;
– communicate details of the registration and exam results with the relevant professional body for the purpose of Synthesis Learning obtaining or maintaining accreditation status with the professional body.

7.2 Candidates have the right to receive details of personal information held about them based on a written request at learning@synthesisgroup.in.

7.3 If the candidate does not wish to receive correspondence from Synthesis Learning a written request should be made to learning@synthesisgroup.in.

7.4 If the candidate wishes to restrict Synthesis Learning processing their information they should make a written request to learning@synthesisgroup.in.

8. Validity

8.1 If any provision of this agreement is held to be invalid or unenforceable the remaining provisions shall not be affected and shall be carried out as closely as possible according to the original intent.

9. Jurisdiction

9.1 This agreement shall be governed and construed in accordance with the laws of India and the parties submit to the exclusive jurisdiction of the courts in Mumbai, India for the determination of disputes arising under this agreement.

10. Privacy

10.1 Synthesis Learning believes that the responsible use of personal information collected on its Web sites is critical to its business objectives and reputation. As part of our commitment to privacy, we have adopted this Online Privacy Statement.

10.2 Some of our Web sites may invite you to register and provide information about yourself. We only use your personally identifiable information to respond to your requests and to personalize your online experience and to deliver the content most suited to your needs. You will be provided with an opportunity to delete your registration information should you no longer wish to receive information from us.

11.8 This site shall be governed by, and your browsing and use of the site shall be deemed acceptance of the treatment under the jurisdiction of the laws of India. A condition of using the site is that in the event of any dispute or proceeding you irrevocably submit to the exclusive jurisdiction of the courts in Mumbai, India and waive any objection to proceedings in such courts on the grounds of the venue and on the grounds that the proceedings have been brought in an inconvenient forum.
